This Privacy Policy discloses how we collect, share, and use information about you that we collect through web site located at www.yolked.com and the YOLKED social media channels, including but not limited to www.yolked.com, Facebook, Instagram, Youtube and Twitter pages (the “Site”). In using and viewing the Site, you may be asked to provide “Personally Identifiable Information” (such as your name, email address, shipping and/or billing address, telephone number, contact preferences, and payment information) and MYOS may use and share this Personally Identifiable Information consistent with the terms of this Privacy Policy.

By using the Site, you are accepting the practices described in this Privacy Policy and accept its terms. You also give your express permission for us to collect, process, store, and use information in accordance with this Policy. This Policy is expressly incorporated into our Terms of Use.

MYOS reserves the right to modify or amend this Privacy Policy at any time and without specific notice to you by posting such changes at the Site. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. Collection of Personally Identifiable Information MYOS collects Personally Identifiable Information that you provide voluntarily or in the course of purchasing products through the Site. Use of the Site is entirely voluntary. Submission of Personally Identifiable Information does not establish any obligation not listed in this Privacy Policy.You are responsible for the Personally Identifiable Information and you must ensure it is legal, honest, truthful, accurate and not misleading in any way. You must ensure that the Personally Identifiable Information provided by you does not infringe on any rights of any third party (including, without limitation, rights of confidentiality), or is otherwise legally actionable by such third party. You have a choice as to whether to provide MYOS with any Personally Identifiable Information. If you chose not to provide Personally Identifiable Information, MYOS may not be able to complete a transaction or respond to your questions, in many cases, and some portions of the Site may not be available to you.

MYOS’ Use of Your Information 

MYOS may use your Personally Identifiable Information in the following limited number of way to:

  • complete a transaction related to a purchase of products through the Site or create an account on the Site;
  • provide customer service and/or marketing products or services (if you don't want to be on our email list, you can opt-out anytime by sending an email to info@yolked.comwith the subject line “unsubscribe”);
  • conduct research and perform analysis to measure, maintain, protect, develop and improve our products and/or services and for loss prevention and anti-fraud purposes;
  • administer a sweepstake or promotion if you enter a sweepstakes or promotion using your Personally Identifiable Information;
  • send communications necessary to notify you regarding order confirmations, products, services, requests, security, privacy, and administrative issues (and since this information is important in your interaction with MYOS, you may not opt-out of receiving these communications);
  • compile demographic statistics about our users; and
  • make a record of your visit and log your IP address, the date and time of your visit to the Site, the pages accessed and any documents downloaded, and the type of browser used.

Occasionally, MYOS may hire other companies to perform services on our behalf such as operating certain aspects of the Site or sending you email. These other companies may be supplied with or have access to your Personally Identifiable Information for the sole purpose of providing these services to us or on our behalf.

In addition, we may need to disclose Personally Identifiable Information when required by law or if we have a good-faith belief that the action is necessary to comply with a pending judicial proceeding, a court order or legal process served on MYOS or to protect our rights or the rights of others, to fight fraud, identity theft, to ensure the integrity and operation of our business and systems, or to protect the rights, property or safety of MYOS, its employees, members or others.

How We Share Your Information 

We will not disclose your Personally Identifiable Information to others without your permission, except as set forth in this Privacy Policy.

Aggregate Information 

On an aggregate basis only, we collect and use comprehensive demographic, business information and data, and other non-Personally Identifiable Information about users of the Site. Aggregated data is considered to not include Personally Identifiable Information.

If MYOS combines aggregated data with Personally Identifiable Information, the combined information will be treated as Personal Identifiable Information for as long as it remains combined. MYOS will never disclose any Personally Identifiable Information as part of this aggregated data but may lend, sell, share or otherwise disclose non-Personally Identifiable Information aggregated data to or with others so we can perform research and provide the results to third parties, enhance and market the Site, and conduct internal accounting and/or other administrative functions.

Updating Your Information 

If you would like to review, delete, or request changes to any of your Personally Identifiable Information that is collected through the Site, please contact us at the postal address listed at the end of this Policy, or at the following email address: info@myoscorp.com.

Please note that deletion of such information may otherwise impact prior transactions performed on the Site.

Other Websites and Links 

The Site may include links to other websites that we think may be of interest to you or operated by our business partners, affiliates, advertisers, and others. These third parties have separate data collection and privacy practices independent from ours, and MYOS will not be responsible for their policies or activities. Please contact those third parties directly if you have questions about their privacy policies.

Social Media

The Site may include social media features and links, and may use social media application programming interfaces (“APIs”) for log-in. The social networking site may collect certain information about you. Please see the privacy policy for the applicable social networking site to learn more about how these social networking sites share your personal information, which practices may differ from ours. If you don't want to follow us on a specific social networking site, you can unfollow/opt out anytime manually according to the terms and conditions as well as instructions on the site.  

Cookies, Web Beacons, Clear Gifs, and IP Addresses 

MYOS may also use “cookies” which is a feature of your browser. A cookie is a small file containing a string of characters that may be sent to your web browser when you visit a website. Cookies might be used to enable certain functions; provide analytics; store your preferences; and enable advertisement delivery and behavioral advertising. A cookie automatically identifies your computer, but not you, to our servers when you visit the Site and allows us to correlate your computer with certain usage patterns which are stored in our log files. We may use cookies to gather general, aggregate statistics about the overall popularity and usage of the Site. MYOS also may use more temporary cookies, often referred to as session cookies, to keep a user logged into the system and aid in the exchange of information between pages without loss of data. Such a cookie, however, is only stored for the current browsing session and is deleted once the browser is closed. MYOS can also only read cookies from the Site. Search for Cookies under your web browser's Help menu for more information on cookie management features available to you. If your browser is set to reject all cookies, the Site may not function properly.

We may also use additional technologies to help track user activities and preferences. We may also collect information through the use of clear gifs (also called Web Beacons) in selected email messages we send to you. These are tiny graphic files, not visible to the human eye, that are included in HTML-based emails and used to let us know which emails we send are opened. Clear gifs may also see or read cookies on your computer. When authorized by MYOS, third parties specializing in monitoring aggregate statistical use of our site with whom we contract, may use cookies, our web log files, web beacons, and other monitoring technologies to compile anonymous aggregate data.

Additionally, we may use IP address information to count and track aggregate visits to Site, to help diagnose problems with our server, and to administer the Site. MYOS does not link IP addresses to anything personally identifiable so while a particular user's session can be tracked, the user remains completely anonymous.

Your California Privacy Rights

Under California Civil Code Section 1798.83, a California customer who has provided Personal Information (as defined under Sub-section 1798.83(e)(6)) to us has may request information about whether the business has disclosed such personal information to third parties for the third parties’ direct marketing purposes.   In general, if a business has made such a disclosure of Personal Information, upon receipt of a request by a customer who is a California resident, the business is required to provide a list of all third parties to whom such information was disclosed in the preceding calendar year, as well as a list of the categories of Personal Information that were disclosed. California customers may request further information about our compliance with this law by e-mailing info@myoscorp.com. Please note that we are required to respond to one request per California customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

Security 

We take appropriate security measures to protect the loss, misuse, and alteration of the information under our control, and we make good faith efforts to store your Personally Identifiable Information in a secure operating environment. Unfortunately, data transmission over the Internet is not completely secure. As a result, while we strive to protect your Personally Identifiable Information, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. If MYOS provides you with a user name and password to access portions of the Site, MYOS disclaims any responsibility for a breach of privacy as a result of your willingly or inadvertently disclosing your user name and password to others.

Children’s Information

This Site is a commercial site and is not intended for use by anyone under eighteen (18) years old. We do not knowingly collect or solicit information from anyone who we know to be under the age of thirteen (13), or knowingly allow such persons to use the Site. To the extent possible, any information from anyone who we know to be under the age of thirteen (13) will be destroyed.

Changes to this Privacy Policy
